a) Bakan: Mill\u00ee E\u011fitim Bakan\u0131n\u0131, <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Bakanl\u0131k: Mill\u00ee E\u011fitim Bakanl\u0131\u011f\u0131n\u0131, <\/p><p>Birle\u015ftirilmi\u015f s\u0131n\u0131f: \u0130lkokullarda birle\u015ftirilerek bir derslikte tek \u00f6\u011fretmen taraf\u0131ndan okutulan birden fazla s\u0131n\u0131f\u0131, <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u00e7) Ge\u00e7ici ikamet: Yang\u0131n, sel, deprem gibi do\u011fal afetler, mevsimlik i\u015fler ve di\u011fer sebeplere ba\u011fl\u0131 olarak <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>yap\u0131lan g\u00f6\u00e7ler nedeni ile ikamet adresinin ge\u00e7ici olarak de\u011fi\u015fmesini, <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Mill\u00ee e\u011fitim m\u00fcd\u00fcrl\u00fc\u011f\u00fc: \u0130l\/il\u00e7e mill\u00ee e\u011fitim m\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fc, <\/p><p>\u00d6\u011frenci ta\u015f\u0131ma uygulamas\u0131: Ta\u015f\u0131ma yoluyla e\u011fitimden faydalanacaklar\u0131n, se\u00e7ilen ta\u015f\u0131ma merkezi kurumlara <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>g\u00fcn\u00fcbirlik ta\u015f\u0131narak e\u011fitim-\u00f6\u011fretime devamlar\u0131n\u0131 sa\u011flamak amac\u0131yla yap\u0131lan uygulamay\u0131, <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u00d6\u011frencisi ta\u015f\u0131nan okul\/kurum: Ta\u015f\u0131ma kapsam\u0131na al\u0131nan resm\u00ee ilk\u00f6\u011fretim, orta\u00f6\u011fretim ile \u00f6zel e\u011fitim <\/p><p>okul\/kurumu ile yayg\u0131n e\u011fitim kurumunu, <\/p><p>\u00d6\u011frencisi ta\u015f\u0131nan yerle\u015fim birimi: \u00d6\u011frenci ta\u015f\u0131ma uygulamas\u0131 kapsam\u0131na al\u0131nan b\u00fcy\u00fck\u015fehir stat\u00fcs\u00fcndeki illerde belde, k\u00f6y veya k\u00f6y alt\u0131 yerle\u015fim yerlerinden mahalle stat\u00fcs\u00fc kazanan ve toplu ta\u015f\u0131ma hizmeti verilmeyen yerle\u015fim birimlerini; b\u00fcy\u00fck\u015fehir stat\u00fcs\u00fc d\u0131\u015f\u0131ndaki illerde ise belde, k\u00f6y ve k\u00f6y alt\u0131 yerle\u015fim yerleri ile daha \u00f6nce k\u00f6y stat\u00fcs\u00fcnde olup belediye s\u0131n\u0131rlar\u0131 i\u00e7erisine al\u0131nan, toplu ta\u015f\u0131ma hizmeti verilmeyen yerle\u015fim birimlerini, <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u011f) Ta\u015f\u0131ma hizmetinden faydalanacaklar: Ta\u015f\u0131ma kapsam\u0131na giren kurumlardan e\u011fitim almak isteyen, \u00f6\u011frenci ta\u015f\u0131ma uygulamas\u0131 kapsam\u0131nda \u00f6\u011frencisi ta\u015f\u0131nan yerle\u015fim biriminde s\u00fcrekli veya ge\u00e7ici ikamet eden \u00f6\u011frenci\/kursiyerler ile \u00f6zel e\u011fitim ihtiyac\u0131 olan \u00f6\u011frenci\/kursiyerlerden okul\/kurum m\u00fcd\u00fcrl\u00fcklerince refakat edilmesine karar verilen a\u011f\u0131r engelli bireyin velisi\/vasisi ya da yaz\u0131l\u0131 olarak yetkilendirdi\u011fi ki\u015fileri, <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Ta\u015f\u0131ma merkezi: Ta\u015f\u0131ma kapsam\u0131na al\u0131nan \u00f6\u011frencilerin \u00f6\u011frenim g\u00f6rd\u00fckleri Bakanl\u0131\u011fa ba\u011fl\u0131 resm\u00ee <\/p><p>okul\/kurumu, <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u0131) Ta\u015f\u0131mal\u0131 \u00f6\u011frenci mod\u00fcl\u00fc: \u00d6\u011frenci ta\u015f\u0131ma uygulamas\u0131 kapsam\u0131nda ta\u015f\u0131ma ve yemek hizmetinden yararlanan \u00f6\u011frenci\/kursiyerlere y\u00f6nelik ger\u00e7ekle\u015ftirilen i\u015f ve i\u015flemlerin elektronik ortamda y\u00fcr\u00fct\u00fcld\u00fc\u011f\u00fc ve bilgilerin sakland\u0131\u011f\u0131 sistemi, <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Toplu ta\u015f\u0131ma hizmeti: Kamu kurum ve kurulu\u015flar\u0131 ile bunlar\u0131n verdi\u011fi yetkiyle ger\u00e7ek ve t\u00fczel ki\u015filer taraf\u0131ndan i\u015fletilen kara, deniz ve su ula\u015f\u0131m ara\u00e7lar\u0131, t\u00fcnel, rayl\u0131 sistem d\u00e2hil her t\u00fcrl\u00fc toplu ta\u015f\u0131ma sistemleri ile belirli aral\u0131klarla verilen mutat ta\u015f\u0131ma hizmetini, ifade eder. <\/p><\/blockquote>\n\n\n\n<p><strong>\u0130K\u0130NC\u0130 B\u00d6L\u00dcM <\/strong><\/p>\n\n\n\n<p><strong>Planlama ve De\u011ferlendirme Komisyonlar\u0131,\nG\u00f6revleri ve Uygulama <\/strong><\/p>\n\n\n\n<h2>Planlama komisyonu <\/h2>\n\n\n\n<blockquote class=\"wp-block-quote\"><p><strong>MADDE 5 \u2013<\/strong> (1) \u0130l ve il\u00e7elerde, her e\u011fitim ve \u00f6\u011fretim y\u0131l\u0131nda; ta\u015f\u0131ma yoluyla e\u011fitimden faydalanacaklar\u0131, ta\u015f\u0131ma kapsam\u0131na al\u0131nacak yerle\u015fim birimlerini ve ta\u015f\u0131ma merkezi okul\/kurumlar\u0131 belirlemek \u00fczere&nbsp; \u201cPlanlama Komisyonu\u201d kurulur. <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Planlama komisyonu; mill\u00ee e\u011fitim m\u00fcd\u00fcrl\u00fc\u011f\u00fcnde ilgili il mill\u00ee e\u011fitim m\u00fcd\u00fcr yard\u0131mc\u0131s\u0131 veya \u015fube m\u00fcd\u00fcr\u00fcn\u00fcn ba\u015fkanl\u0131\u011f\u0131nda, en az ikisi ta\u015f\u0131ma merkezi okul\/kurum m\u00fcd\u00fcr\u00fc olmak kayd\u0131yla ilk\u00f6\u011fretim, orta\u00f6\u011fretim ve \u00f6zel e\u011fitim okul\/kurumu ile yayg\u0131n e\u011fitim kurumu m\u00fcd\u00fcrleri aras\u0131ndan se\u00e7ilen ba\u015fkan d\u00e2hil en az \u00fc\u00e7, en fazla dokuz \u00fcyeden olu\u015fur. <\/p><p>Planlama komisyonu; mill\u00ee e\u011fitim m\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn uygun g\u00f6r\u00fc\u015f\u00fc ve mahall\u00ee m\u00fclki idare amirinin onay\u0131 ile ocak ay\u0131 i\u00e7inde olu\u015fturulur, mill\u00ee e\u011fitim m\u00fcd\u00fcrl\u00fc\u011f\u00fcnce haz\u0131rlanan \u00e7al\u0131\u015fma takvimine g\u00f6re bir y\u0131l s\u00fcre ile \u00e7al\u0131\u015f\u0131r. <\/p><p>Planlama komisyonu, ta\u015f\u0131ma yoluyla e\u011fitimden faydalanacaklara ili\u015fkin planlamalar\u0131 yapmak \u00fczere \u015fubat ay\u0131n\u0131 ge\u00e7meyecek \u015fekilde komisyon ba\u015fkan\u0131n\u0131n uygun g\u00f6rece\u011fi tarihlerde toplan\u0131r. <\/p><p>Kendi b\u00f6lgelerindeki \u00f6\u011frenci\/kursiyerlerin ta\u015f\u0131ma kapsam\u0131na al\u0131nmas\u0131 ile ilgili g\u00f6r\u00fc\u015flerini bildirmek \u00fczere ihtiya\u00e7 duyulmas\u0131 h\u00e2linde, ilgili yerle\u015fim birimlerinin muhtarlar\u0131, belediye ba\u015fkanlar\u0131 ile kamu kurum ve kurulu\u015flar\u0131n\u0131n yetkilileri de toplant\u0131ya davet edilebilir. <\/p><\/blockquote>\n\n\n\n<h2>Planlama komisyonunun g\u00f6revleri <\/h2>\n\n\n\n<blockquote class=\"wp-block-quote\"><p><strong>MADDE 6 \u2013<\/strong> (1) Planlama komisyonunun g\u00f6revleri \u015funlard\u0131r: <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Toplant\u0131 tarihi itibar\u0131yla il\/il\u00e7e mahall\u00ee m\u00fclki idare ve belediye m\u00fccavir alan s\u0131n\u0131rlar\u0131 i\u00e7indeki toplu ta\u015f\u0131ma hizmetlerini de\u011ferlendirmek suretiyle \u00f6\u011frencisi ta\u015f\u0131nacak veya kapsam d\u0131\u015f\u0131 b\u0131rak\u0131lacak yerle\u015fim birimleri ile ta\u015f\u0131ma yoluyla e\u011fitimden faydalanacaklar\u0131, ta\u015f\u0131ma kapsam\u0131na giren kurumlar baz\u0131nda tespit etmek, <\/p><p>\u00d6\u011frenci say\u0131s\u0131 ve ula\u015f\u0131m imk\u00e2nlar\u0131na g\u00f6re, ta\u015f\u0131nacak \u00f6\u011frencileri ve \u00f6\u011frencisi ta\u015f\u0131nacak yerle\u015fim birimlerini <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>grupland\u0131rarak, ta\u015f\u0131ma merkezi okullar\u0131 tespit etmek, <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Her bir ta\u015f\u0131ma merkezi okul\/kuruma \u00f6\u011frencisi ta\u015f\u0131nacak yerle\u015fim birimi ile \u00f6\u011frenci say\u0131s\u0131n\u0131 dikkate alarak, <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u00f6\u011frencilerin ka\u00e7 ara\u00e7la ta\u015f\u0131naca\u011f\u0131n\u0131, arac\u0131n izleyece\u011fi yol ve duraklar\u0131 ile hareket saatlerini belirlemek, <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u00e7) \u00d6\u011frencilerin g\u00fcvenli \u015fekilde ta\u015f\u0131nmalar\u0131, sa\u011fl\u0131k ve beslenme konular\u0131nda al\u0131nacak \u00f6nlemleri belirlemek, <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u00d6\u011frencileri ta\u015f\u0131ma kapsam\u0131na al\u0131narak kapat\u0131lan okul\/kurumlar\u0131n bina ve tesisleri ile ders ara\u00e7lar\u0131 ve ta\u015f\u0131n\u0131rlar\u0131n\u0131n \u00f6ncelikle ta\u015f\u0131ma merkezi okul\/kurumlar\u0131n ihtiya\u00e7lar\u0131n\u0131 kar\u015f\u0131lamak amac\u0131yla mill\u00ee e\u011fitim m\u00fcd\u00fcrl\u00fc\u011f\u00fcne \u00f6neride bulunmak, <\/p><p>\u0130klimi ve ula\u015f\u0131m \u015fartlar\u0131 ta\u015f\u0131maya elveri\u015fsiz olan yerle\u015fim birimlerindeki ilk\u00f6\u011fretim kurumlar\u0131nda \u00f6\u011frenim g\u00f6rmekte olan \u00f6\u011frencileri, \u00f6ncelikle yat\u0131l\u0131 b\u00f6lge ortaokullar\u0131na yerle\u015ftirdikten sonra, ta\u015f\u0131ma kapsam\u0131na al\u0131nacak di\u011fer \u00f6\u011frencilerin planlamas\u0131n\u0131 yapmak, <\/p><p>Bulundu\u011fu yerle\u015fim yerinde \u00f6\u011frenim g\u00f6rece\u011fi e\u011fitim kurumu olmayan \u00f6\u011frencilerin tespitini yaparak, ba\u015fka bir il\/il\u00e7edeki ta\u015f\u0131ma merkezine \u00f6\u011frencisi ta\u015f\u0131nacak okul ve yerle\u015fim birimlerindeki \u00f6\u011frencilerin ta\u015f\u0131naca\u011f\u0131 okullar\u0131 planlayarak de\u011ferlendirme komisyonuna bildirmek, <\/p><p>\u0130lkokul ve ortaokul \u00f6\u011frencilerine y\u00f6nelik mart ay\u0131nda; <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u00d6\u011frencisi ta\u015f\u0131nacak okul ve yerle\u015fim birimlerine g\u00f6re daha merkez\u00ee durumda olmas\u0131, \u00e7evredeki di\u011fer yerle\u015fim birimleri ile ula\u015f\u0131m imk\u00e2nlar\u0131na sahip, geli\u015fmeye uygun olmas\u0131, <\/p><p>Derslik, at\u00f6lye ve laboratuvar say\u0131s\u0131 ile fiziki kapasitenin yerle\u015fim yerindeki \u00f6\u011frenciler ile ta\u015f\u0131ma <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>kapsam\u0131na al\u0131nan \u00f6\u011frenci say\u0131s\u0131n\u0131n e\u011fitimine yeterli olmas\u0131, <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u00d6\u011fretmen ve ders ara\u00e7-gerecinin yeterli olmas\u0131, <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u00e7) \u00d6\u011frencilerin sosyal, k\u00fclt\u00fcrel ve sportif faaliyetler ile kitapl\u0131k ve k\u00fct\u00fcphanelerden yararlanabilmeleri i\u00e7in <\/p><p>uygun ortamlar\u0131n bulunmas\u0131, \u015fartlar\u0131 aran\u0131r. <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Zorunlu sebepler d\u0131\u015f\u0131nda yat\u0131l\u0131 b\u00f6lge ortaokullar\u0131 ve ikili e\u011fitim yapan okul\/kurumlar\u0131n ta\u015f\u0131ma merkezi okul olarak se\u00e7ilmemesi, <\/p><p>Ta\u015f\u0131ma merkezi olacak ilkokulda birle\u015ftirilmi\u015f s\u0131n\u0131f uygulamas\u0131 yap\u0131lmaz. Ancak zorunlu h\u00e2llerde planlama komisyonunun teklifi, il de\u011ferlendirme komisyonunun karar\u0131 ve mahall\u00ee m\u00fclki idare amirinin onay\u0131 ile uygulama yap\u0131labilir. <\/p><p>\u00d6\u011frenci ta\u015f\u0131ma uygulamas\u0131nda ilkokul, ortaokul, imam-hatip ortaokulu, orta\u00f6\u011fretim \u00f6\u011frencileri ile \u00f6zel e\u011fitim ihtiyac\u0131 olan \u00f6\u011frenci\/kursiyer\/velilerin ayr\u0131 ayr\u0131 ara\u00e7larla ta\u015f\u0131nmas\u0131 esast\u0131r. Uygun nitelik ve nicelikte ara\u00e7 bulunamamas\u0131 durumunda, ilgili okul d\u00fczeyinde yerle\u015fim yerinde az say\u0131da \u00f6\u011frenci bulunmas\u0131, ders giri\u015f-\u00e7\u0131k\u0131\u015f saatlerinin yak\u0131n olmas\u0131 ve ara\u00e7ta yer olmas\u0131 \u015fart\u0131yla \u00f6zel e\u011fitim \u00f6\u011frenci\/kursiyerleri d\u0131\u015f\u0131ndaki \u00f6\u011frenciler birlikte ta\u015f\u0131nabilir. <\/p><\/blockquote>\n\n\n\n<h2>\u00d6\u011frencisi ta\u015f\u0131nacak okul ve yerle\u015fim biriminde aranacak \u015fartlar <\/h2>\n\n\n\n<blockquote class=\"wp-block-quote\"><p><strong>MADDE 8 \u2013<\/strong> (1) Toplu ta\u015f\u0131ma hizmeti bulunmayan, \u00f6\u011frencisi ta\u015f\u0131ma kapsam\u0131na al\u0131nacak okul ve yerle\u015fim biriminin se\u00e7iminde; <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>N\u00fcfusun az veya da\u011f\u0131n\u0131k olmas\u0131, \u00f6\u011frenci say\u0131s\u0131ndaki yetersizlik, yerle\u015fim yerinin co\u011frafi \u00f6zellikleri, yol \u015fartlar\u0131, <\/p><p>E\u011fitime eri\u015fim ihtiyac\u0131 olan \u00f6\u011frencinin s\u00fcrekli veya ge\u00e7ici ikamet etti\u011fi yerle\u015fim yerinde bu ihtiyac\u0131n\u0131 <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>kar\u015f\u0131layaca\u011f\u0131 t\u00fcrde e\u011fitim kurumu bulunmamas\u0131 veya bu kurumlar\u0131n kapal\u0131 olmas\u0131, <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Do\u011fal afetler, salg\u0131n hastal\u0131klar, can ve mal kayb\u0131 tehlikesi gibi ani ve beklenmedik olaylar\u0131n ortaya \u00e7\u0131kmas\u0131 <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>ve\/veya bu olaylar sonucunda; tamir, g\u00fc\u00e7lendirme, bertaraf veya tedavi \u00e7al\u0131\u015fmalar\u0131 yap\u0131l\u0131yor olmas\u0131, <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u00e7) G\u00f6\u00e7ler ve mevsimlik i\u015f\u00e7i hareketleri olmas\u0131, gibi \u00f6zellikler aran\u0131r. <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u00d6\u011frencisi ta\u015f\u0131nacak yerle\u015fim yerinin ta\u015f\u0131ma merkezine uzakl\u0131\u011f\u0131n\u0131n en az 2 kilometre olmas\u0131 esas olup, 50 kilometreden daha fazla mesafeden ta\u015f\u0131ma yap\u0131lmaz. Birinci f\u0131krada say\u0131lan \u00f6zellikler sebebiyle bu mesafelerin art\u0131r\u0131l\u0131p azalt\u0131lmas\u0131na gerek\u00e7e belirtmek suretiyle Planlama Komisyonu karar verebilir. <\/p><p>En az bir ders y\u0131l\u0131 paras\u0131z yat\u0131l\u0131 \u00f6\u011frenim g\u00f6ren orta\u00f6\u011fretim \u00f6\u011frencileri ta\u015f\u0131ma kapsam\u0131nda de\u011ferlendirilebilir. Paras\u0131z yat\u0131l\u0131l\u0131ktan \u00f6\u011frenci ta\u015f\u0131ma uygulamas\u0131na ge\u00e7i\u015fler i\u00e7in ba\u015fvurular, \u00f6\u011frenci velisi taraf\u0131ndan paras\u0131z yat\u0131l\u0131 olarak \u00f6\u011frenim g\u00f6rd\u00fc\u011f\u00fc okul m\u00fcd\u00fcrl\u00fc\u011f\u00fcne, ders bitiminden temmuz ay\u0131n\u0131n sonuna kadar yap\u0131l\u0131r. Okul m\u00fcd\u00fcrl\u00fcklerinden gelen bu veriler, paras\u0131z yat\u0131l\u0131l\u0131k ve bursluluk komisyonunun g\u00f6r\u00fc\u015fleri de al\u0131narak Planlama Komisyonunca de\u011ferlendirilir. <\/p><\/blockquote>\n\n\n\n<h2>\u00d6zel e\u011fitim \u00f6\u011frenci\/kursiyerlerinin ta\u015f\u0131nmas\u0131 <\/h2>\n\n\n\n<blockquote class=\"wp-block-quote\"><p><strong>MADDE 9 \u2013<\/strong> (1) \u00d6zel e\u011fitim okul\/kurum\/s\u0131n\u0131f\u0131 \u00f6\u011frencileri ile yayg\u0131n e\u011fitim hizmetinden yararlanan \u00f6zel e\u011fitime ihtiyac\u0131 olan bireyler ders y\u0131l\u0131 i\u00e7inde ve 8 inci maddede yer alan \u015fartlar aranmaks\u0131z\u0131n kay\u0131tl\u0131 olduklar\u0131 okul\/kurum\/s\u0131n\u0131flara ta\u015f\u0131n\u0131r. <\/p><\/blockquote>\n\n\n\n<h2>De\u011ferlendirme komisyonu <\/h2>\n\n\n\n<blockquote class=\"wp-block-quote\"><p><strong>MADDE 10 \u2013<\/strong> (1) \u00d6\u011frencisi ta\u015f\u0131ma kapsam\u0131na al\u0131nacak yerle\u015fim birimleri ve okullar ile ilgili Planlama <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Komisyonu taraf\u0131ndan haz\u0131rlanan raporlar\u0131 de\u011ferlendirmek ve il\/il\u00e7eler aras\u0131nda e\u015f g\u00fcd\u00fcm\u00fc sa\u011flamak \u00fczere \u201cDe\u011ferlendirme Komisyonu\u201d kurulur. <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>De\u011ferlendirme Komisyonu; orta\u00f6\u011fretim okul\/kurumlar\u0131nda, ders y\u0131l\u0131 i\u00e7erisinde i\u015fletmelerde mesleki e\u011fitime devam eden \u00f6\u011frencilerden \u015fartlar\u0131 uyanlar\u0131n kay\u0131tl\u0131 oldu\u011fu okula kadar g\u00fczerg\u00e2h de\u011fi\u015fikli\u011fi yapmadan ta\u015f\u0131nmas\u0131na ili\u015fkin planlamalar\u0131 yaparak, \u00f6\u011frenci velisinden yaz\u0131l\u0131 izin almak ve bu durumdaki \u00f6\u011frencilerin say\u0131lar\u0131n\u0131 mill\u00ee e\u011fitim m\u00fcd\u00fcrl\u00fc\u011f\u00fcne bildirmek. <\/p><\/blockquote>\n\n\n\n<h2>Rehber personel <\/h2>\n\n\n\n<blockquote class=\"wp-block-quote\"><p><strong>MADDE 14 \u2013<\/strong> (1) \u00d6zel e\u011fitim ihtiyac\u0131 olan \u00f6\u011frenci\/kursiyerlerin ta\u015f\u0131nd\u0131\u011f\u0131 ara\u00e7larda \u00fccreti ve her t\u00fcrl\u00fc sosyal haklar\u0131 ihale dok\u00fcmanlar\u0131nda belirlenerek y\u00fcklenici taraf\u0131ndan kar\u015f\u0131lanmak \u00fczere bir rehber personel g\u00f6revlendirilir. <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>(2) Rehber personel g\u00f6revlendirmesinde; mesleki ve teknik e\u011fitim okul\/kurumlar\u0131n\u0131n acil sa\u011fl\u0131k hizmetleri, hasta ve ya\u015fl\u0131 hizmetleri, hem\u015firelik ile \u00e7ocuk geli\u015fimi ve e\u011fitimi alan\u0131 mezunu olmak tercih sebebi olarak kabul edilir. Bu alanlardan mezun personel bulunamamas\u0131 h\u00e2linde bu Y\u00f6netmelik kapsam\u0131nda ta\u015f\u0131nan \u00f6zel e\u011fitim ihtiyac\u0131 olan \u00f6\u011frenci\/kursiyerlerin birinci dereceden yak\u0131nlar\u0131na \u00f6ncelik verilir. <\/p><\/blockquote>\n\n\n\n<h2>Rehber personelin g\u00f6revleri <\/h2>\n\n\n\n<blockquote class=\"wp-block-quote\"><p><strong>MADDE 15 \u2013<\/strong> (1) \u00d6zel e\u011fitim \u00f6\u011frencileri ile yayg\u0131n e\u011fitim hizmetlerinden yararlanan \u00f6zel e\u011fitim kursiyerlerinin ta\u015f\u0131nmas\u0131nda g\u00f6revli rehber personel; <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Okula\/kuruma geli\u015fteki ilk \u00f6\u011frenci\/kursiyerin al\u0131nd\u0131\u011f\u0131 noktadan \u00f6nce servis arac\u0131nda bulunmak ve <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>okul\/kurumdaki e\u011fitim-\u00f6\u011fretim bittikten sonra en son \u00f6\u011frenci\/kursiyerin indi\u011fi noktaya kadar ara\u00e7ta bulunmak, <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Refakat etti\u011fi \u00f6\u011frenci\/kursiyerlerin g\u00fcvenli ve emniyetli bir \u015fekilde araca bini\u015f ve ini\u015fleri ile geli\u015f ve <\/p><\/blockquote>\n\n\n\n<p>gidi\u015flerine yard\u0131mc\u0131 olmak, <\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Ta\u015f\u0131ma i\u015flemlerine ili\u015fkin olarak okul-aile-\u00f6\u011frenci\/kursiyer ili\u015fkilerinde ortaya \u00e7\u0131kan sorunlar\u0131 ilgililere <\/p><p>zaman\u0131nda bildirmek, <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u00e7) Ta\u015f\u0131ma i\u015fini yapan servis arac\u0131nda bulundu\u011fu zamanlar d\u0131\u015f\u0131ndaki e\u011fitim-\u00f6\u011fretim saatlerinde okul\/kurumda bulunmak ve sorumlulu\u011funda olan \u00f6\u011frenci\/kursiyerlere y\u00f6nelik sa\u011fl\u0131k, beslenme ve temizlik konular\u0131nda yard\u0131mc\u0131 olmak \u00fczere okul\/kurum m\u00fcd\u00fcr\u00fcn\u00fcn verdi\u011fi g\u00f6revleri yapmak, i\u015f ve i\u015flemlerinden sorumludur. <\/p><\/blockquote>\n\n\n\n<p><strong>\u00dc\u00c7\u00dcNC\u00dc B\u00d6L\u00dcM <\/strong><\/p>\n\n\n\n<p><strong>\u0130hale \u0130\u015flemleri <\/strong><\/p>\n\n\n\n<h2>\u0130halelerde dikkat edilecek hususlar <\/h2>\n\n\n\n<blockquote class=\"wp-block-quote\"><p><strong>MADDE 16 \u2013<\/strong> (1) \u00d6\u011frenci ta\u015f\u0131ma uygulamas\u0131 kapsam\u0131nda ta\u015f\u0131ma ve yemek ihalelerine ili\u015fkin i\u015flemler 4\/1\/2002 tarihli ve 4734 say\u0131l\u0131 Kamu \u0130hale Kanunu h\u00fck\u00fcmlerine g\u00f6re yap\u0131l\u0131r. <\/p><p>(2) \u0130hale s\u00f6zle\u015fmeleri ve ihale \u015fartnameleri haz\u0131rlan\u0131rken; <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Ta\u015f\u0131ma merkezi okul ve kurum m\u00fcd\u00fcrlerinin de g\u00f6r\u00fc\u015fleri al\u0131n\u0131r. <\/p><p>\u0130lkokul ve ortaokullarda ta\u015f\u0131ma hizmeti al\u0131m s\u00fcreci en ge\u00e7 a\u011fustos ay\u0131n\u0131n ikinci haftas\u0131nda, imam-hatip ortaokulu ve orta\u00f6\u011fretim okul\/kurumlar\u0131nda ise kay\u0131t kabul i\u015flemlerinin tamamlanmas\u0131ndan sonra en k\u0131sa s\u00fcrede bitirilir. Ancak, ara\u00e7 bulmada zorluk \u00e7ekilen b\u00f6lgelerdeki normal e\u011fitim yapan ta\u015f\u0131ma merkezi okula, e\u011fitim-\u00f6\u011fretimi aksatmamak \u00fczere planlama komisyonlar\u0131n\u0131n belirleyece\u011fi mesafelerde bir ara\u00e7la en fazla iki sefer yap\u0131larak \u00f6\u011frenci ta\u015f\u0131nabilir. Ayr\u0131ca ikili e\u011fitim yapan ta\u015f\u0131ma merkezi okula da sabah\u00e7\u0131 \u00f6\u011frenciler i\u00e7in bir, \u00f6\u011flenci \u00f6\u011frenciler i\u00e7in bir sefer olmak \u00fczere bir ara\u00e7la en fazla iki sefer yap\u0131larak \u00f6\u011frenci ta\u015f\u0131nabilir. <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u00d6\u011frenci ta\u015f\u0131mac\u0131l\u0131\u011f\u0131n\u0131n kara yolu ile yap\u0131lamad\u0131\u011f\u0131 yerlerde valilik onay\u0131 al\u0131narak deniz yolu ile de ta\u015f\u0131ma yap\u0131labilir. Deniz yolu ile yap\u0131lacak ta\u015f\u0131mada Ula\u015ft\u0131rma, Denizcilik ve Haberle\u015fme Bakanl\u0131\u011f\u0131nca yolcu ta\u015f\u0131nmak \u00fczere belgelendirilmi\u015f deniz ara\u00e7lar\u0131 kullan\u0131l\u0131r. Ta\u015f\u0131ma yapacak deniz ara\u00e7lar\u0131n\u0131n, 10\/6\/1946 tarihli ve 4922 say\u0131l\u0131 Denizde Can ve Mal Koruma Hakk\u0131nda Kanun\u2019da \u00f6ng\u00f6r\u00fclen nitelikleri ta\u015f\u0131mas\u0131 gerekir. Deniz ara\u00e7lar\u0131nda, bu Kanun uyar\u0131nca gerekli olan belge ve teknik te\u00e7hizatlar ile ki\u015fi ba\u015f\u0131 TSE veya ISO onayl\u0131 \u0131\u015f\u0131kl\u0131 ve d\u00fcd\u00fckl\u00fc \u00e7ocuk can yele\u011fi bulundurulur. Kamu kurum ve kurulu\u015flar\u0131 ile yapt\u0131klar\u0131 hizmet kar\u015f\u0131l\u0131\u011f\u0131 olarak herhangi bir \u00f6demede bulunulmas\u0131 konusunda protokol yap\u0131lamaz. <\/p><\/blockquote>\n\n\n\n<h2>Yemek hizmetleri <\/h2>\n\n\n\n<blockquote class=\"wp-block-quote\"><p><strong>MADDE 20 \u2013<\/strong> (1) Ta\u015f\u0131ma uygulamas\u0131 kapsam\u0131nda ta\u015f\u0131nan \u00f6zel e\u011fitim \u00f6\u011frenci\/kursiyerleri d\u0131\u015f\u0131ndaki ilk\u00f6\u011fretim ve orta\u00f6\u011fretim \u00f6\u011frencilerine \u00f6\u011fle yeme\u011fi verilir. Yemekler, Kamu \u0130hale Kanunu h\u00fck\u00fcmlerine g\u00f6re temin edilir. <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Ta\u015f\u0131ma uygulamas\u0131 kapsam\u0131nda ta\u015f\u0131nan \u00f6\u011frencilere, okul pansiyonlar\u0131 mevzuat\u0131 do\u011frultusunda okul ve pansiyon yemekhanelerinde \u00f6\u011fle yeme\u011fi verilebilir. Yemek bedeli ilgili okulun hesab\u0131na aktar\u0131l\u0131r. <\/p><p>Yemek hizmetlerinde y\u00fcr\u00fcrl\u00fckteki mevzuat h\u00fck\u00fcmleri uygulan\u0131r. Yemeklerin haz\u0131rlanmas\u0131nda ve sunulmas\u0131nda besin de\u011ferinin korunmas\u0131na ve sa\u011fl\u0131\u011fa uygunlu\u011funa gerekli \u00f6zen g\u00f6sterilir. <\/p><p>Ta\u015f\u0131ma uygulamas\u0131 kapsam\u0131 d\u0131\u015f\u0131ndaki \u00f6\u011frencilere yemek hizmeti verilmez. Ancak, Sosyal Yard\u0131mla\u015fma ve Dayan\u0131\u015fma Vak\u0131flar\u0131 verileri de dikkate al\u0131narak okul m\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan tespit edilen ve ta\u015f\u0131ma uygulamas\u0131 kapsam\u0131nda olmayan \u00f6\u011frencilere \u00f6\u011fle yeme\u011fi verilebilir. <\/p><p>Ta\u015f\u0131ma uygulamas\u0131 kapsam\u0131nda olan ancak ikili e\u011fitim yap\u0131lan okullarda ta\u015f\u0131ma uygulamas\u0131 kapsam\u0131nda yemek hizmeti verilmez. <strong>Sorumluluk <\/strong><\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p><strong>MADDE 21 \u2013<\/strong> (1) Bu Y\u00f6netmelik kapsam\u0131ndaki i\u015f ve i\u015flemleri y\u00fcr\u00fcten personel; saydaml\u0131\u011f\u0131, rekabeti, e\u015fit muameleyi, g\u00fcvenirli\u011fi, kamuoyu denetimini, ihtiya\u00e7lar\u0131n uygun \u015fartlarla ve zaman\u0131nda kar\u015f\u0131lanmas\u0131n\u0131 ve kaynaklar\u0131n verimli kullan\u0131lmas\u0131n\u0131 sa\u011flamakla sorumludur. <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u0130hale yetkilisi ile ihale komisyonlar\u0131n\u0131n ba\u015fkan ve \u00fcyeleri ile ihale i\u015flemlerinden s\u00f6zle\u015fme yap\u0131lmas\u0131na kadar ihale s\u00fcrecindeki her a\u015famada g\u00f6rev alan di\u011fer ilgililerin; g\u00f6revlerini kanuni gereklere uygun veya tarafs\u0131zl\u0131kla yapmad\u0131klar\u0131n\u0131n, taraflardan birinin zarar\u0131na yol a\u00e7acak ihmalde veya kusurlu hareketlerde bulunduklar\u0131n\u0131n tespiti h\u00e2linde, haklar\u0131nda ilgili mevzuat gere\u011fince disiplin cezas\u0131 uygulan\u0131r. gereklerine uygun olarak haz\u0131rlanmas\u0131 ve uygulanmas\u0131ndan, mill\u00ee e\u011fitim m\u00fcd\u00fcrl\u00fcklerine tahsis edilen \u00f6deneklerin ve di\u011fer kaynaklar\u0131n etkili, ekonomik ve verimli \u015fekilde kullan\u0131lmas\u0131ndan, kay\u0131p ve k\u00f6t\u00fcye kullan\u0131m\u0131n\u0131n \u00f6nlenmesinden, \u00f6\u011frenci ta\u015f\u0131ma uygulamas\u0131n\u0131n y\u00f6netim ve kontrol sisteminin i\u015fleyi\u015finin g\u00f6zetilmesinden, bu Y\u00f6netmelikte belirtilen g\u00f6rev ve sorumluluklar\u0131n yerine getirilmesinden sorumludurlar. <\/p><p>Mill\u00ee e\u011fitim m\u00fcd\u00fcrl\u00fcklerinin ta\u015f\u0131ma yoluyla e\u011fitime eri\u015fim i\u015f ve i\u015flemlerini d\u00fczenleyen usul ve esaslar\u0131n haz\u0131rlanmas\u0131nda a\u015fa\u011f\u0131daki hususlar g\u00f6z \u00f6n\u00fcnde bulundurulur: <\/p><p>Ta\u015f\u0131ma uygulamas\u0131 ve y\u00f6netimi, uyumlu bir b\u00fct\u00fcn olarak olu\u015fturulur ve y\u00fcr\u00fct\u00fcl\u00fcr. <\/p><p>E\u011fitim hakk\u0131ndan yoksun kalmas\u0131 muhtemel b\u00fct\u00fcn \u00f6\u011frenci\/\u00f6zel e\u011fitim kursiyerlerinin ta\u015f\u0131ma yoluyla <\/p><p>e\u011fitime eri\u015fimlerini sa\u011flayacak tedbirler belirlenir. <\/p><p>E\u011fitime eri\u015fimi kolayla\u015ft\u0131ran, her vatanda\u015f\u0131n e\u011fitim f\u0131rsat ve imk\u00e2nlar\u0131ndan e\u015fit derecede yararlanabilmesini <\/p><p>teminat alt\u0131na alan bir \u015fekilde olu\u015fturulur ve y\u00fcr\u00fct\u00fcl\u00fcr. yap\u0131lmas\u0131, yang\u0131n, sel, deprem gibi do\u011fal afete u\u011framas\u0131 h\u00e2linde \u00e7\u00f6z\u00fcm bulununcaya kadar \u00f6\u011frenciler, \u00f6\u011frenci ta\u015f\u0131ma komutanl\u0131\u011f\u0131 ile i\u015f birli\u011fi yap\u0131larak okul servis arac\u0131 s\u00fcr\u00fcc\u00fclerine, uyacaklar\u0131 kurallar ve g\u00f6sterecekleri davran\u0131\u015flar konusunda e\u011fitim ve \u00f6\u011fretim y\u0131l\u0131 ba\u015f\u0131nda ve uygun g\u00f6r\u00fclen di\u011fer zamanlarda kurs ve seminer verilebilir.
